Jurisdiction depends on the location of both the intervention and its effects, including any effects extending into national waters.

Ocean iron fertilisation: High seas and areas beyond national jurisdiction.
The high seas are not a permission-free zone and do not have one universal OIF permit office.

- 02
The vessel flag, material-loading State, operator and ports determine connections to national regulatory systems.

Relevant frameworks include national LC/LP implementation, the Ocean Fertilization Assessment Framework, BBNJ obligations for Parties, environmental assessment and sectoral or area-based measures.
Competent authorities
Regulatory bodies and rightsholders.
- Flag-State maritime, environment and research authorities
- Loading-State and port-State authorities
- LC/LP national focal points and implementing regulators
- BBNJ national focal points for Parties where applicable
- Regional fisheries bodies, protected-area managers and other sectoral organizations
Legal conditions
Applicable legal frameworks.
- LC-LP.1(2008) and LC-LP.2(2010) frame ocean fertilisation and scientific assessment; they do not themselves issue permission.
- The BBNJ Agreement entered into force on 17 January 2026 and adds obligations for Parties in areas beyond national jurisdiction.
- Vessel nationality, loading and port activity can connect national law to a high-seas proposal.
- A commercial or carbon-credit purpose does not prove that an activity is legitimate scientific research.
Project-specific questions
Applicability and authorization.
- Which States are legally connected through vessel, operator, loading and port arrangements?
- Which BBNJ environmental-impact and information-sharing processes apply to the proposal and participating States?
- Which fisheries, shipping, protected-area or other bodies cover the footprint?
- Can exposure, effects, monitoring, intervention and remediation be demonstrated for the entire moving footprint?
